In 2014, the federal Department of Justice issued guidance acknowledging the ability of tribal nations to pursue marijuana development projects on tribal lands without federal interference. Since the release of the Wilkinson memo, many tribal nations have enacted regulations permitting commercial cannabis activity and some have entered into joint ventures with private non-tribal entities to pursue these business activities. Mr. Roger’s presentation will provide a general overview of various federal, state, and tribal law issues that arise with such ventures and discuss potential methods for minimizing risk in this new regulatory environment.
